This Agreement governs your access and use of the BROCODE website ("Website") and any related services or content provided by us. DEFINITIONS

"We," "our," or "us" refers to NADI MEDICINE SDN. BHD., the operator of the online pharmacy (BROCODE).

"You" or "your" refers to the user or customer accessing our BROCODE services.

"Product(s)" refers to the pharmaceutical items and related products available for purchase on our BROCODE website.

 

SECTION 2: COMPLIANCE WITH MALAYSIAN LAW

2.1. Our BROCODE operates strictly in accordance with the laws and regulations of Malaysia that govern the operation of online pharmacies, including, but not limited to, the Sale of Drugs Act 1952, the Poisons Act 1952, the Medicines (Advertisement and Sale) Act 1956, the Dangerous Drugs Act 1952, the Control of Drugs and Cosmetics Regulations 1984, the Pharmacy Act 1951, and the Pharmacy Registration Act 1951.

 

2.2. By using our services, you acknowledge that you are solely responsible for complying with all applicable laws and regulations regarding the purchase, possession, and use of pharmaceutical products in Malaysia.

 SECTION 4: PRESCRIPTION MEDICATIONS

4.1. Dispensation of prescription medications is contingent upon your submission of a valid prescription from a registered medical practitioner in Malaysia. We strictly adhere to the regulations set forth by the Pharmacy Act 1951 and the Control of Drugs and Cosmetics Regulations 1984.

 

4.2. By submitting a prescription, you confirm that the prescription was issued by a registered medical practitioner, and you bear sole responsibility for ensuring its authenticity and accuracy.

 

SECTION 5: PRODUCT INFORMATION AND AVAILABILITY

5.1. While we strive to provide accurate and up-to-date information about our products, including their descriptions, prices, and availability, errors or discrepancies may occur. We do not guarantee the accuracy or completeness of such information.

 

5.2. We reserve the right to modify the prices, descriptions, or availability of any products on our website without prior notice. Additionally, we retain the right to limit the quantities of products available for purchase.

 

SECTION 6: ORDERS AND PAYMENT

6.2. The acceptance of your order is subject to verification of your prescription and other relevant information. We reserve the right to refuse or cancel any order at our discretion, including instances where we suspect fraudulent activity or a violation of this Agreement.

 

6.3. Payment for the products and any associated delivery charges must be made in accordance with the payment methods provided on our website.

 

SECTION 7: SHIPPING AND DELIVERY

7.1. We endeavor to process and dispatch orders promptly. However, delivery times may vary due to factors beyond our control, such as courier services and customs clearance.

 

7.2. We make reasonable efforts to ensure that the products are securely packaged and delivered to the address you provided. Nonetheless, we assume no liability for lost, stolen, or damaged products during transit.

 

SECTION 8: RETURNS AND REFUNDS

8.1. Due to the nature of pharmaceutical products, we cannot accept returns or provide refunds for products once they have been dispatched, except in cases where the product received is incorrect or damaged.

 

8.2. If you receive an incorrect or damaged product, you must notify us within FOURTEEN (14) days of receipt. We may require you to provide supporting documentation, such as photographs, to facilitate the processing of your claim.

11.1. This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Malaysia.

 

By using our BROCODE services, you acknowledge that you have read, understood, and agreed to this Agreement. If you do not agree with any part of this Agreement, you may not use our services.
